From 2013 to 2018, Wells Fargo deceptively collected an estimated hundreds of millions of dollars in service fees on its most popular checking account products: Everyday Checking and Opportunity Checking. Wells Fargo recently admitted in an SEC filing that serious problems existed with these accounts, and that customers were charged incorrectly. However, Wells Fargo has declined to publicly announce how it intends to fix this problem and reimburse consumers harmed by its improper practices.

Wells Fargo charges customers $10 per month to maintain an Everyday Checking or Opportunity Checking account but waives that fee in certain scenarios, for example if the customer conducts at least ten transactions in a month. ATM withdrawals do not count towards the ten-transaction tally, but for years, and despite Wells Fargo’s knowledge of widespread confusion amount its customers, Wells Fargo failed to inform customers of the exclusion of these transactions from Wells Fargo’s calculations. Wells Fargo has expressed that refunding these improper charges is “the right thing to do,” but has not yet refunded customers overcharged by the bank’s practices.
