Many car wreck cases can be settled without anyone having to go to court. In the first case, an FDA client was waiting at a stoplight in 2019 when his vehicle was rear-ended by another driver, causing serious injuries. The at-fault driver’s insurance company, State Farm, offered to settle the case for $20,000. FDA attorneys Joseph Sirchio and Dylan Unger took the case to trial. The jury awarded their client $85,000 in economic damages, $15,000 in non-economic damages, and $30,000 for physical impairment resulting from the accident.
“We believed that our client deserved better than what State Farm offered, and the jury agreed,” Sirchio said.
That victory came practically on the heels of another plaintiff’s verdict in another courtroom. An injured FDA client had to undergo neck surgery after her accident, but the at-fault party’s insurance company raised liability issues and pre-existing medical conditions as hurdles to settlement. The other side’s final offer before trial was $100,000 — far less than the plaintiff’s medical expenses. FDA attorneys Natalie Brown and Jordan Coley went to trial. On February 26, after more than five hours of deliberation, the jury decided their client was entitled to $227,000, enough to cover her full medical costs, as well as an award for pain and suffering and impairment.
