Throwing Out Wrongful Death Claims in Theater Shooting

U.S. Magistrate Judge Michael Hegarty said claims of Wrongful Death and Negligence, in the Aurora Century 16 theater should not be considered, and thrown out. Hegarty claims that laws in Colorado disallow victims, and their families, from filing such claims.

James Holmes, suspected of the shooting, is currently in prison. Holmes, has been charged with 24 counts of first-degree murder. 12 people were killed in the shooting spree, and two counts of murder are being brought against Holmes for each victim.

Judge Hegarty has only recommended the wrongful death and negligence claims be thrown out, he has not made any kind of official ruling on the matter.
